Hmmm - perhaps the solution is to make mod_include look at the response returned before inserting the entity - and optionally dump the entity depending on the error. All mod_proxy does with the entity is send it as a bucket brigade up the filter stack. It's up to mod_include to decide what should be done with the brigade - it can quite easily throw it away if configured to do so.
