If the Ubuntu logo is like the Java "Duke" logo, then it's covered with an open source license (Duke usage is covered by BSD licence). This means that as with everything covered by an open source license (see for reference point 3 at : http://www.opensource.org/docs/osd) it must allow derived works... And this can be claimed to be a derived works.

Now it all depends on how the Ubuntu logo is distributed, but I wouldn't be surprised that it came with either a BSD license (which would allow derived commercial works like T-Shirts) or GPL (which makes it more complex to create such derived commercial works). In which case, what we see here may be a despicable, but certainly legitimate use of the nice Ubuntu logo.

We just need to be careful, possibly with a "don't fall to false logos" campain... but a lawsuit won't help.
