The patch has never been committed. Niklas said there was some other work going on with the driver and that the fix would be incorporated or a patch released for 3.3. Either way, you should be able to build your own kernel from 3.1, 3.2, or 3.3 with this patch and install it on the PERC 3Di box without too much hassle.
